Everything about this story sucks. A couple in a 1950's Porsche Speedster (I can’t identify the exact year) were enjoying a sunny drive in San Diego when they were crashed into by a woman who was driving her Toyota Corolla under the influence of marijuana. The car jumped the median prior to colliding with the Porsche. The couple is in serious condition, and the woman has been released from the hospital and arrested.

*Update 1: McMike commented that this is the 1956 Porsche 356A Speedster that Petrolicious featured in a video in 2014 (see below). The owner’s name is Jon Warshawsky, a Director at Deloitte. The two in the Speedster at the time of the accident were Jon and his girlfriend.

The DUI suspect has 3 prior DUI convictions, the 2 passengers in the Porsche are still on Life support, and considered to be Brain Dead.

Jeez... that sucks. Reminds me of some friends of my parents. Their son and his wife were hit by a drunk driver while coming home from a baby shower (someone else’s, not theirs... they hadn’t had kids yet). Anyway, wife was killed instantly, son was paralyzed and died from complications from his injuries a year later. The woman who hit them? It was her third DUI and she was only 23 years old.

I have friends who have been pretty unresponsive for a while after too many edibles or whatever. Just not a good idea to drive under the influence. Plus, she has 3 prior DUI convictions, so who knows what else she might have consumed.

Murder, by definition, requires premeditation and intent. Neither of those things happened here. Hence, manslaughter exists.
Murder charges have been used in these kinds of cases, but it’s an incredibly high bar to clear. Either way, this woman should be in a dark room, in the fetal position, praying constantly that these people survive.
While we’re on the subject though, you do raise an interesting point. If someone had misused a firearm 3 times, in a way that could cause death, would we continue to allow them to own the firearm? I hope not. By that same token, why was this woman still allowed to drive after 3 DUIs?

I was considering the choice to drive while impaired the premeditation to whatever outcome, but it’s a vindictive and unhelpful view to have on the subject, so I won’t try to justify myself any more. But that is a very good point, 3 DUIs really seems like enough for a properly long license ban, if not permanent.

In Texas they have “Vehicular Homicide” as the choice when the driver is impaired or otherwise commits gross negligence (i.e. street racing) and it results in an accident with fatalities.

This is a horrible story. I have no tolerance for people who drive under the influence. IMHO, the first DUI should get the VEHICLE revoked. Not having a license doesn’t really stop anybody. Take away their car and they can’t go anywhere.
